| Use Policy The
terms and conditions of this Use policy apply to all Internet access services provided by
Autumn Internet Exchange and Services, hereinafter referred to as AIX. AIX may
amend or replace this Use Policy at any time without notice.
1. The Customer may use the services
provided by AIX to access, store and disseminate works via the Internet. Since AIX
provides a passive service and does not publish, author, or approve works or content which
are accessed, stored, or disseminated, it has no rights of ownership and no responsibility
for such works or content. The Customer is responsible for all works or content
posted, stored, or transmitted by the use of the services provided by AIX.
2. Services provided to the Customer by
AIX shall not be used in a manner which violates any applicable law or regulation,
threatens the proper operation of the system of AIX or other Internet participants, or
threatens the security of the accounts or works of Customers of AIX or other Internet
participants. More specifically, the Customer shall not do any of the following
(i)
abuse, restrict, or inhibit any other user of the service(s) and/or the Internet, (ii)
post or transmit any unlawful, obscene, or pornographic information of any kind, including
without limitation any transmissions constituting or encouraging conduct that would
constitute criminal offense, give rise to civil liability, or otherwise violate any local,
state, national, or international law, (iii) post or transmit any information or software
which contains a virus or other harmful component, (iv) copy, upload, post, publish,
transmit, reproduce, or distribute in any way, information software, or other material
which is PROTECTED BY A COPYRIGHT or other proprietary right, or derivative works with
respect thereto, without obtaining permission of the copyright owner or right holder, (v)
transmit any unsolicited bulk email, spam, advertisements, or chain letters, or transmit
or distribute large quantities of unsolicited or unwanted email to individual email
accounts, (vi) transmit or distribute any email after receiving a request to stop from the
addressee, (vii) transmit or distribute any message or information which contains Internet
routing information, (viii) compromise the security or tamper with the system resources or
files of any site or computer of AIX or other Internet participants, or use, transmit, or
distribute any program, utility, or file that can be used to allow unauthorized access or
gain unauthorized information about a computer, network, or file, (ix) use the
service(s)
in a manner that substantially encumbers disk space, processors, or other system resources
of AIX or other Internet participants, (x) engage in line camping (the use of dial-up
connections when no information is being transmitted or received) or use anti-idle or
automatic reconnect programs or devices, (xi) or abuse or fraudulently use the
service(s)
in any way not specifically set forth above. If AIX becomes aware of the possible
violation of any of these prohibitions, it may initiate an investigation and disable the
Customer's service(s) and account. If it is determined that a violation of these
prohibitions has occurred, AIX may provide Customer's name, address, and account
information to law enforcement authorities, other Internet participants, or affected
Internet users, and may terminate the Customer's service(s) and account.
3. While security on the system is a high
priority, AIX does not warrant or guarantee the security or privacy of any information
posted, stored, or transmitted by the use of the service(s) provided by AIX. Due to
the public nature of the Internet, all information should be considered publicly
accessible, and important or private information should be treated with care.
4. AIX must perform scheduled maintenance
and/or augmentation on its systems and/or services from time to time. AIX will
attempt to provide advance notice of such activities to the Customer. However, AIX
shall not credit the Customer's account or provide any refund to the Customer on account
of such activities.
5. Customers shall provide complete and
accurate information in establishing their AIX service(s) and accounts, and shall pay all
charges that accrue through authorized use of their accounts. The Customer's name
and/or password shall not be provided to anyone else. Dial-up Customers shall not
allow others to use or share their service(s) or account(s), shall not use or share the
service(s) or account(s) of other Customers, and shall not log-in as another
Customer. Customers who utilize their dedicated service(s) or
account(s) to provide service(s) or account(s) to intermediate users or end-users shall require the intermediate
users and end-users to accept and agree to the terms and conditions set forth in this Use
Policy.
6. In the event that Customers, who
utilize their dedicated service(s) or account(s) to provide service(s) or
account(s) to
intermediate users or end-users, cease providing such service(s) or
account(s) to the
intermediate users or end users, AIX shall have no obligation to provide such
service(s)
or account(s) to the intermediate users or end users.
7. At the request of the Customer, AIX
will provide assistance in obtaining the registration of the Customer's domain name and/or
the assignment of IP address in accordance with the requirements, regulations, and
guidelines of the InterNIC Registry. Customer shall provide to AIX all required
information and shall pay all required fees and charges. AIX shall have no
obligation respecting the registration or use of the domain name or the assignment of IP
addresses other than to use reasonable efforts to process the request of the Customer.
